최형두 의원 "네이버, 언론사 뉴스컨텐츠 지적재산권 보장해야"

브레이크뉴스 정명훈 기자= 최형두 국민의힘 의원은 7일 포털사이트 네이버가 언론사로부터 제공받는 뉴스컨텐츠에 대해 합당한 지적재산권료를 지급해야 한다고 주장했다.

최형두 의원은 이날 국회 과학기술정보방송통신위원회 국정감사에서 증인으로 출석한 네이버 정책 책임자에게 "국내독과점 뉴스포털 네이버가 독점적인 뉴스유통 지배력을 바탕으로 언론사들의 수익기반을 잠식하고 있다"면서 "네이버는 언론사 지배수단으로 인식되는 제휴평가위원회를 해체하고 뉴스컨텐츠 수익이 직접 생산한 언론사에게 공정하게 배분될 수 있도록 아웃링크 시스템으로 가야한다"고 촉구했다.

최 의원은 "네이버는 지난해 11월 언론사들에게 네이버 언론사 뉴스 서비스를 아웃링크로 전환할 기회를 주겠다고 했다가 약속한 올해 3월 돌연 약속을 철회한 사실이 있다"며 "이로 인해 당시 네이버의 약속을 믿고 비용을 지출해 사이트와 서버를 업그레이드 했다가 손해를 본 언론사들도 있다"고 소개했다.

이어 "네이버가 하이퍼클로바나 하이퍼클로바X를 구축하며 언론사들이 지난 수십년에서 1백여년 이상 축적하고 지금도 매일 수천 수만건씩 생산하고 있는 뉴스컨텐츠에 대한 정당한 지적재산권 보상을 지급하지 않고 있다"는 언론계 지적도 언급하며 "네이버는 더이상 우리나라의 언론생태계, 민주주의 기반을 잠식하지 말고 외국 AI회사처럼 언론사들의 컨텐츠에 정당한 보상을 하는 방안마련에 착수해야 한다"고 주장했다.

최 의원은 "실제 네이버는 지난해 언론사들이 제공한 기사를 AI가 무단 학습할 수 있도록 하는 불공정한 약관 조항을 일방적으로 통보했다가 언론사들이 한 목소리로 비판하자 물러섰다"면서 "그 과정에 구 약관 조항을 활용해 AI 학습 목적으로 언론사들의 기사 저작권을 침해했다고 스스로 인정했다"고 지적했다.

그는 또한 "네이버는 국내 뉴스유통의 70% 전후를 독점하고 있는 것으로 평가되는데 네이버가 뉴스 유통을 독점하면서 언론사들이 돈을 위해 저질 연성기사를 앞다퉈 생산하는 경쟁을 부추기고 있다"며 "대한민국 민주주의의 근간인 저널리즘의 질적 저하에 유통업자에 불과한 네이버가 미치는 악영향은 지대하다"고 비판했다.

그는 특히 "네이버는 이런 상황에서 이달 말 제평위 재개를 공식 발표하겠다는 것은 지금껏 언론계와 정치권, 여론이 지적한 문제들을 무시하겠다는 뜻 아니냐"면서 "네이버는 제평위 재개에 앞서 아웃링크 선택제 도입, AI 기사 저작권 침해에 대한 배상에 대한 구체적인 방안부터 내놓아서 뉴스 유통독점에 따른 대한민국 저널리즘 황폐화를 개선할 수 있는 대안을 마련해야 한다"고 꼬집었다.

그러면서 "이제 네이버도 가두리양식 방식인 인링크 뉴스 장사를 그만두고 아웃링크 뉴스 검색창으로서 포털 본연의 기능으로 돌아가라는 사회적 요청에 응답해야 한다"고 덧붙였다.
