브레이크뉴스 박동제 기자= 민희진 어도어 전 대표 측이 아일릿의 뉴진스 표절을 재차 주장하며 하이브 내부 직원에게 제보받은 증거를 제출했다.
11일 오전 서울중앙지법 민사합의50부(수석부장판사 김상훈)는 민희진 어도어 전 대표가 하이브를 상대로 낸 의결권 행사 등 가처분 소송 심문기일을 열었다.
이날 민희진 측은 가처분 사건 심문기일에 대한 구두변론 자료를 전달하며 “하이브 내부 직원은 아일릿 크리에이티브 디렉터가 아일릿 구상 단계부터 뉴진스의 기획안을 요청했고, 아일릿의 기획안이 뉴진스의 기획안과 똑같다고 제보했다”고 밝혔다.
이어 “제보자는 아일릿 크리에이티브 디렉터의 요청으로 자료를 전달했지만 ‘똑같이 만들 거라고는 정말 상상도 못 했다. 다 똑같은 자료가 법원에 제출돼 있는 것 같은데 이거 다 보고 참고한 건데 왜 계속 아니라고 하지?’라며 빌리프랩에서 해당 표절의혹이 허위사실이라고 주장하는 것에 마음이 불편하다고 토로했다”고 전했다.
앞서 지난 5월 아일릿의 소속사 빌리프랩은 민희진 측의 뉴진스 표절 주장 관련해 “소속 아티스트를 상대로 일방적 허위사실을 주장하며 피해를 끼치고 있는 민희진에 대해 업무방해와 명예훼손 혐의의 고소장을 제출했다”며 “민희진 측이 당사 소속 아티스트 아일릿에 대한 표절 의혹을 제기한 것과 관련해 사실이 아님을 명확히 밝힌다. 당사는 해당 의혹이 사실과 다름을 증명할 수 있는 근거 자료를 사법 기관에 제출했으며, 시일이 다소 소요되더라도 적법한 절차에 따라 시시비비를 가려낼 것”이라고 밝힌 바 있다.
민희진 측은 “이처럼 명백한 사실이 있음에도 빌리프랩은 표절의혹이 사실이 아니라고 지속적으로 부인하고 하이브는 이를 방치했다. 민희진 전 대표는 지난 4월 3일 ‘아일릿의 뉴진스 카피’에 대해 내부적으로 문제제기를 했는데, 이러한 문제 제기가 정당했음이 객관적 증거에 의해 명확히 드러난 것”이라며 “하이브는 민희진 전 대표의 내부적인 문제제기에 대해 감사로 응수했지만, 이로써 하이브의 감사는 정당성이 전혀 없는 불법감사임이 다시 한번 확인됐다”고 주장했다.
또 “하이브는 아일릿의 뉴진스 카피를 방치한 것 외에도 뉴진스 역바이럴, 직장 내 괴롭힘 은폐, 흠집내기용 언론플레이 등 수없이 많은 배신행위와 괴롭힘을 자행했으며 법원의 선행 가처분 결정도 무시한 채 주주간계약이 해지됐다고 일방적으로 주장하고 있다”고 밝혔다.
그러면서 “이에 민희진 전 대표는 하이브가 임시주주총회에서 ‘사내이사 민희진 선임의 건’에 대해 찬성하는 내용의 의결권을 행사해야 하고, 하이브가 선임한 이사들이 어도어 이사회에서 ‘대표이사 민희진 선임의 건’에 대해 찬성하는 내용의 의결권을 행사하도록 업무집행을 지시햐야 한다는 가처분신청을 하게 된 것”이라고 덧붙였다.
한편, 하이브 레이블 어도어는 앞서 지난 8월 27일 이사회를 열고 ‘경영권 탈취 시도’ 관련 갈등을 빚고 있는 민희진을 해임, 김주영 어도어 사내이사를 신임 대표이사로 선임했다.
이에 민희진 전 대표 측은 지난 8월 28일 공식입장을 내고 “어도어 이사회는 8월 27일 오후 1시 개최된 이사회에서 대표이사 민희진을 해임했다. 이번 해임 결정은 주주간 계약과 의결권행사금지 가처분 결정에 정면으로 반하는 위법한 결정”이라며 반발했다.
그러자 어도어 측은 “금일 어도어 이사회는 안건 통지, 표결 처리까지 모두 상법과 정관이 정한 절차에 따라 적법하게 진행됐다. 개최 일정은 민희진 전 대표가 연기를 희망해온 날짜 가운데 정한 것”이라며 “민 전 대표는 화상으로 참석한 가운데, 이사회는 충분한 논의를 거친 후 어도어와 뉴진스의 미래를 위해 최선의 선택을 했다”고 맞섰다.
이후 뉴진스 멤버 전원은 하이브와 방시혁 의장을 향해 최근 해임된 민희진 어도어 전 대표의 복귀를 요구하는 최후통첩을 남겼다.
뉴진스는 지난달 11일 유튜브 채널 ‘nwjns’를 통해 ‘뉴진스가 하고 싶은 말’이라는 제목으로 긴급 라이브 방송을 진행하며 “(민희진) 대표님을 복귀시켜 주고, 지금의 낯선 환경과 낯선 사람들이 아닌 원래의 자리로 돌려놔달라”며 “우리가 원하는 건 민희진 대표님께서 대표로 있는 경영과 프로듀싱이 통합된 원래의 모습이다. 하이브는 25일까지 어도어를 원래대로 복귀시키는 현명한 결정을 해주길 바란다”는 입장을 전했다.
민희진 역시 지난달 13일 대표직 복직을 요구하며 하이브를 상대로 임시주주총회 소집 및 어도어 사내이사 재선임을 위한 가처분 소송을 제기했다.
